One European country is lowering the age of sexual consent to 15, and they wanted to go even lower than that in the beginning. According to BBC, France is planning to set the legal age of sexual consent to 15. This means, of course, that sex with anyone under that age would be considered assault (cưỡng dâm).

Age of consent laws seek to protect the autonomy (tự chủ) of the young by proscribing (cấm) sexual relationships where their consent is inherently impaired (vốn đã hư hỏng). However, the other part of protecting that autonomy is acknowledging that youth – specifically during the teen-age years when puberty (dậy thì) arrives – is a time of transition and experimentation (thử nghiệm). We must be careful to avoid a situation where laws meant to protect the young instead end up punishing them.

The Amendment made in the Juvenile Justice (Care and Protection of Children) Act 2015, a juvenile (vị thành niên) in the age group of 16 to 18 years of age is considered as an adult. It specifically mentions that 16 year olds to 18 year olds accused in cases of rape are to be tried as adults in special courts, constituted under the Juvenile Justice Act, 2015. This indicates the legislative policy (chính sách lập pháp) that young adults in the age group of 16 to 18 are capable of taking responsibility for their actions. However, no corresponding relaxation (nới lỏng) has been made for prescribing the age of consent under Section 375 of the Indian penal code (bộ luật hình sự) in the issue of statutory (theo luật định) rape. The age of consent was in fact increased from 16 to 18. I argue for lowering the age of consent to 16.
