"Miscarriage of justice" có miscarriage là sự hỏng mất bào thai trong tử cung; sự sẩy thai, sự thất bại (kế hoạch) và justice là công lý, tư pháp -> từ này nghĩa là sự thất bại của một toà án trong việc xét xử đúng đắn; vụ án xử sai; vụ án xử oan; ngộ phán.
